Swish Connect is a tool which our Users can use to communicate, interact and share information. With our Services, our Users share their profiles, exchange expertise and industry insights, post and view interactive and relevant content and information, and extend their community through Swish Connect. We value your privacy and this Privacy Policy, applies to your use of our Services.
As a User of our Services, the collection, use and sharing of your personal data is subject to this Privacy Policy and other documents referenced in this Privacy Policy, as well as updates.
Registration. To create an account you need to provide data including your name and email address. A one time password will be sent to your registered email address each time you log in.
Profile. Your basic profile will consist of your name, email address, employer, and job title. You may choose to disclose optional profile information including your office address, phone number, social media accounts and job industry. However, we remind our Users not to post or add personal data to your profile that you would not want to be available to other Users of Swish Connect or our Services.
Data From Others. We may receive information about you from other Users from their User Content.
Content and News. You and other Users may post content that includes information about you (as part of articles, posts, comments, videos) on our Services.
Service Use. We maintain a log of your access to our Services. We log usage data when you visit or otherwise use our Services, including our sites, app and platform technology, such as when you view or click on content (e.g., learning video)), perform a search, use a feature available on our Services, share content or react to content from other Users. We use log-ins, device information (including device model, software version, specifications) and internet protocol (“IP”) addresses to aid user identification and authentication.
Device information. We receive data from your devices and networks, including location data. When you visit or leave our Services (including some plugins and our cookies or similar technology on the sites of others), we receive the URL of both the site you came from and the one you go to and the time of your visit. We also get information about your network and device (e.g., IP address, proxy server, operating system, web browser and add-ons, device identifier and features, cookie IDs and/or ISP, or your mobile carrier, device time-zone). If you use our Services from a mobile device, that device will send us data about your location based on your phone settings.
We use your data to provide, support, personalise and develop our Services.

Service provision. We receive a data log on the content you view or when you use the Services on Swish Connect e.g when you log into Swish Connect, interact with our notifications. The data log includes information such as your IP address, mobile carrier, device information. We also receive a data log when you interact with the content on Swish Connect i.e click, view or share the links. This data log is depersonalised and is used to operate the Services and to ensure their performance.
We use data about your network and device (Operating system, device identifier, device-timezone), in crash reports, analytics to improve the application efficiency and customizing content on the application to fit your time-zone. (I.e. event timing, message time, time of broadcast, date of posts etc.)
Information sharing. We will contact you through email, notices posted on Swish Connect or such other ways as We may deem appropriate through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. Please be aware that You cannot opt out of receiving service messages from us, including security and legal notices.
Developing Services and Research. We develop our Services and conduct research to understand our user habits, improve our Services, improve our user interfaces and provide a more positive experience.
Service Development. We use data, including public feedback, to improve our Services in order to provide you and others with a better, interactive and personalized experience, so that We may enhance our User community and their engagement on our Services, and ultimately facilitate connections among our Users.
We may conduct polls and surveys through our Services from time to time. You are not obligated to respond to polls or surveys. However, if You choose to participate, We may use the information You have provided.
Customer Support. We use data to help you and fix problems. We use data (which can include your communications) to investigate, respond to and resolve complaints and for Service issues (e.g., bugs).
Security and Investigations. We may use data to enforce or to investigate any violations or breaches of the Terms of Service or this Privacy Policy and to protect our Users from misuse or breaches of the Terms of Services or Privacy Policy.
Our Services. Any data that you include on your profile and any content you post or reactions or responses (e.g., likes, follows, comments, shares) you take on our Services will be seen by others, consistent with your settings.
Profile. Your profile will be available to other Users who are employees of the same organisation You are in or members of the same interest group. Your profile cannot be publicly viewed or accessed through search engines.
Posts, Likes, Follows, Comments, Messages. Subject to your chosen settings, our Services allow viewing and sharing information including through posts, likes, follows and comments.
Interactions with other Users. We enable communications between Users and provide certain features which allows You to decide who has access to your profile and who may communicate with You. You may join a interest group on Swish Connect and interact with other Users who are members of the same interest group. Any User in the group will be able to see the User Content You post and message you directly, subject to the privacy settings you choose.
Users who are not members of the same interest group or organisation may message each other directly if both Users consent to be added as each other’s contact. When you like or comment on another User’s content publicly, others will be able to view these actions and associate it with you (e.g., your name, profile and photo if you provided it).
Third Party Providers. We may use other providers to help us with our Services. We will only share data as reasonably necessary for such third party providers to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes. The data will not be sold/resold to any third parties for any purposes outside of the tasks above.
Legal and regulatory obligations. We may need to share your data when we believe it is required by applicable law or to help protect the rights and safety of you, us or others.
Data Retention. Your information is retained as long as the purpose for which it was collected remains and until it is no longer necessary for any other legal, regulatory or business purposes, maintain security, prevent misuse of our Service (in circumstances where your account was terminated for breach), enforce the Terms of Service or fulfil any request from you to unsubscribe from our mailing list.
To the extent that you have shared information with other Users through Swish Connect, whether by way of posts, direct messages, reactions, such content will remain available on Swish Connect notwithstanding that you may have deleted your account, or deleted the content on your account. We do not have any control over how the other Users may use that information.
Correction of Personal Data. If you would like to update the data you have provided to us, you can access your account to view and make changes or corrections to your data in the Setting page. Only the email address will not be editable as this is tied to your account.
We monitor for and try to prevent security breaches. Please use the security features available through our Services. We implement security safeguards designed to protect your data, such as HTTPS. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
We may amend this policy from time to time and we will notify you of any changes to the policy by stating the last modified date at the top of this policy. If you object to any changes, you may close your account. You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Privacy Policy, as of its effective date.

Swish Connect ("Our," "We," or "Us") provides messaging, texting, collaboration functions and other services to you ("User", "You"). You are advised to read our Terms of Service as this governs our relationship with You. By installing, accessing, or using our app, its services or features, You agree to our Terms of Service and You enter into a legally binding agreement with Us.
These Terms apply to Swish Connect and any Swish Connect related sites, communications and other services ("Services") which may be offered under these Terms.
Registration. You must register for an account to use our Services. You are required to provide your name, email, phone number to register for an account ("Account"). You agree to receive text messages or emails (from us or our third-party providers) with codes or hyperlinks to verify your Account.
If You are registering for an account on behalf of a company or business, You represent and warrant that You are authorized to agree to these Terms of Service and all other applicable terms, policies, and documentation ("Terms").
Devices and Software. You must provide certain devices, software, and data connections to use our Services, which we otherwise do not supply. For as long as you use our Services, you consent to downloading and installing updates to our Services, including automatically.

You will not use (or assist others in using) our Services in ways that: (a) violate, misappropriate, or infringe the rights of Swish Connect, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) are illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, or otherwise inappropriate; (c) involve publishing falsehoods, misrepresentations, or misleading statements; (d) impersonate someone or create a false profile; (e) develop, support or use software, bots, or any other automated processes in regards to data scraping or copy information or User profile or content from Swish Connect; (f) involve any non-personal use of our Services unless otherwise authorized by us.
The do nots of Swish Connect. You must not (or assist others to) access, use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our Services in impermissible or unauthorized manners, or in ways that burden, impair, or harm us, our Services, systems, our users, or others, including that you must not directly or through automated means: (a) reverse engineer, alter, modify, create derivative works from, decompile, or extract code from our Services; (b) Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without Our consent; (c) perform any functions or actions that may amount to monitoring for any competitive purpose; (d) send, store, or transmit viruses or other harmful computer code through or onto our Services; (e) gain or attempt to gain unauthorized access to our Services or systems; (f) interfere with or disrupt the integrity or performance of our Services; (g) create accounts for our Services through unauthorized or automated means; (h) collect the information of or about our users in any impermissible or unauthorized manner; (i) sell, resell, rent, or charge for our Services; or (j) distribute or make our Services available over a network where they could be used by multiple devices at the same time.
Keeping Your Account Secure. You are responsible for keeping your device and your Swish Connect account safe and secure, and you must notify us promptly of any unauthorized use or security breach of your account or our Services.
Content Access. The Swish Connect is intended to facilitate collaboration, and You may message and share information with other Users, including your profile, your username, articles, group posts, messaging functions and such information ("User Content") as You may post or share on Swish Connect. User Content may be view or shared by other Users of Swish Connect. Your User Content may be removed after a reasonable period of time from Swish Connect to keep Swish Connect updated with fresh User Content. You acknowledge and agree that We have no obligation to store or retain a copy of your User Content, except as required by applicable law.
Sharing controls. Where We have enabled such features or settings for You to hide or restrict access to User Content You have uploaded, made available or published on Swish Connect, your User Content will be restricted in accordance with your chosen settings.
You understand and agree that You will not obtain, through use of the Swish Connect or our Services any right, title, or interest (including intellectual property rights) to User Content which is published, uploaded, transmitted, made accessible by any other User.
We do not claim ownership of any User Content that you upload, make available or publish through Swish Connect or through our Services. You must have the necessary rights to the User Content that You upload or make available on Swish Connect. You assume all risks associated with Your User Content, including the other User's or a third party's reliance on its quality, accuracy, or reliability, and You agree that You are solely responsible for any consequences that may arise the User Content. Your User Content must not contain material that is false, intentionally misleading, or defamatory; violates third-party rights; or contains material that is unlawful or advocates the violation of any law or regulation ("Acceptable Use Policy").
By using Swish Connect, You may also encounter User Content from other Users that is objectionable, inaccurate, offensive, misleading or otherwise inappropriate.
In order for us to provide You with the services, You grant Swish Connect a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to copy, modify, distribute, use, reproduce, distribute, create derivatives works of and display the User Content that You upload, submit, store, send, or receive on or through the Swish Connect. This license is for the limited purposes of editing and formatting your User Content for publication or use on Swish Connect. Content may be held with Users which You may have previously shared the content with and to the extent they have re-shared, stored the content.
Intellectual Property. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our express permission.
Swish Connect's License to You. We grant you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use Swish Connect, subject to and in accordance with our Terms. This license is for the sole purpose of enabling you to use our Services, in the manner permitted by our Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.
The collection and use of your personal information shall be governed by our Privacy Policy.
Our Services may allow you to access, use, or interact with third-party websites, apps, content, and other products and services ("Third Party Services"). We are also not responsible nor liable for the content and information available on those Third Party Services and if You choose to access any Third Party Services, You do so at your own risk. Please note that when you use Third Party Sites their own terms and privacy policies will govern your use of those services.
We may send notices or messages to You through the following methods: (a) within the Swish Connect; (b) to any of the contact details You have provided to Us. You agree to notify us promptly of any changes to your contact information.
YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE ARE PROVIDING OUR SERVICES ON AN "AS IS" BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. WE DO NOT WARRANT THAT ANY ACCURACY, COMPLETENESS OR RELIABILITY OF INFORMATION PROVIDED BY US, YOU RELEASE US, OUR SUBSIDIARIES, AFFILIATES, AND OUR AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AND AGENTS (TOGETHER, THE "Swish Connect PARTIES") FROM ANY CLAIM, COMPLAINT, CAUSE OF ACTION, CONTROVERSY, OR DISPUTE (TOGETHER, "CLAIM") AND DAMAGES, KNOWN AND UNKNOWN, RELATING TO, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH ANY SUCH CLAIM YOU HAVE AGAINST ANY THIRD PARTIES.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE Swish Connect PARTIES WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES, EVEN IF THE Swish Connect PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100).
You agree to defend, indemnify, and hold harmless the Swish Connect from and against all liabilities, damages, losses, and expenses of any kind (including reasonable legal fees and costs) relating to, arising out of, or in any way in connection with any of the following: (a) your access to or use of our Services, including information provided in connection therewith; (b) your breach or alleged breach of our Terms; or (c) any misrepresentation made by you. You will cooperate as fully as required by us in the defence or settlement of any Claim.
Forum and Venue.
Governing Law. The laws of the Singapore govern our Terms, as well as any Disputes, whether which might arise between Swish Connect and You.
Availability of Our Services. Our Services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time. Events beyond our control may affect our Services, such as events in nature and other force majeure events.
Termination. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms or create harm, risk, or possible legal exposure for us, our users, or others. The Clauses "Licenses," "Disclaimers," "Limitation of Liability," "Indemnification," "Dispute Resolution," "Availability and Termination of our Services" will survive any termination of your relationship with Swish Connect.
Unless expressly stated otherwise, no third party rights are granted under these Terms.
No Waiver. No failure or delay by Us to exercise or in exercising, any right hereunder shall operate as a waiver of our rights thereof. And the exercise of any right hereunder shall not preclude the exercise of any other right, and the remedies provided hereunder are cumulative and not exclusive of any remedies provided at law or in equity. If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from our Terms and shall not affect the validity and enforceability of the remaining provisions.
Amendment. We may amend or update these Terms. We will provide you notice of amendments to our Terms, as appropriate, and update the "Effective Date" at the top of our Terms. Your continued use of our Services confirms your acceptance of our Terms, as amended. If you do not agree to our Terms, as amended, you must stop using our Services. Please review our Terms from time to time.
Severability. If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from our Terms and shall not affect the validity and enforceability of the remaining provisions.
